help - pr and residency orders

hi if my ex partner has parental responsability but our 15 month daughter lives with me full time can he for example take her out for the day and not return her legally. if he can is there anything i can put in place to stop this like a residency order or something
please help i can see this coming he is not returning her when he is supposed to hours late it is only a matter of time when he does not return her for the night or days or worse

i had the same problem with my ex when our daughter was 6mnths old.if you ex is on the birth certificate then he has rights so id see a solicitor for advice,they give 30mins advice for free unless u are on income support when its free anyway.if hes not on birth certificate he has no rights at all.best get advice asap.good luck.x

hya thanks, he does not have pr yet but i agreed he can go on the birth certicate which means he will automatically get pr just panicing now that he could do a runner and there is nothing i could do to stop him or legally get her back
Get a residency & contact order through the family court (a solicitor can advise).

Your daughter needs to have contact with her dad, indeed he needs contact with her too ~ but he must realise that a proper routine is needed.

Hi Pippa thanks for that will that set out guidlines for things like him returning her when agreed, i mean we all have such a good relationship at the moment and are both flexible about when and how long he has her and i dont want that to change by us agruing about him not returning her for the evening and things like that maybe it wont happen but i would hate for him to ruin us all getting on by not bringing her back and having her for days on end as he now sees this pr thing as a power thing.

also he does not have her overnight yet s he lives so far away and she is still a bit to young and he doesnt have anywhere for her to sleep if i have a contac t order will this mean he then gets to have her over the weekend or can we come to an arrangement about it just being days at the moment and then review it when she is older

yes ~ times/days can be set out and it is best if you can both come to an agreement amicably :o)

It would be much better for your daughter in the long run if she starts to stay overnight with her dad ~ I know she is a little young right now, but as she gets older it would be better for her not to have the travelling in such a short space of time. I found this worked better in my situation, and both my ex & I found it nicer not to have to watch the clock!

if your ex lives so far away then traffic problems may be preventing him from returning your daughter at an agreed time. It is great that things are good in your relationship right now..I do hope it continues for everyone's sakes.

get a residency order in place and quick! Then get the contact order started. It will hopefully work out for the best of all three of you in the long run.

Your daughter will probably be encouraged to stay over night, but your ex will have to be deemed fit to have her over night and that will take awhile until he gets the go ahead.

If you are being flexible - excellent, but still get this in the contact order and make it known that you understand that travelling will sometimes prevent your ex from brining your daughter on time, ask for your ex to make sure he lets you know if he is runing late - other wise you will call the Police. Hopefully, you wont ever have to do that, but it might frighten your ex enough to make an extra effort.

Thank you all for your support and advice , everything is going great, we are respecting each others wishes more and he checks in with me if he is running late, he says he has no inention on just taking her without my say so as it would upset our daughter so its good we both have her in mind, we even all went to the zoo the other day and my daughter loved us both being there.
