how do you go about getting your name off a joint mortgage when relationship fails

My sister and her partner bought a house in November. To date they have only made one mortgage repayment. They have separated in the last few days and she needs to know if she can get her name taken off the mortgage and how she goes about this. Can you advise please?

If the mortgage lender consents to whatever is proposed they will consider it to be a "Transfer of Equity" by your sister to her ex and will insist upon doing all of the work themselves (both your sister's and theirs) with the Land Registry and Revenue. A charge of about �250 is usual. Some circumstances give rise to a liability to Stamp Duty, so your sister should check to avoid being surprised by an unexpected bill. Four or five signatures by the ex will be required, so your sister should try to keep a reasonable liason open.
