I know someone who has recently received a chequebook from her bank. She is over her overdraft, and has started paying for goods by cheque. I'm guessing these will subsequently bounce, that her bank will charge her everytime they represent, but what are the chances of legal action being taken against her?

If she is using a cheque guarantee card, the bank have to honour them but they will eventually cancel her card so she can't use it anymore and yes, she will be charged an unauthorised overdraft fee. If she is not using her card, the cheques will bounce and she will be charged for each one - usually around 25.
It is illegal to issue cheques knowing that you don't have the funds to cover them. I have never heard of a Bank taking legal action against anyone for doing so though, and I worked for one for 20 years.
i cant recall the exact details but a friend i knew years ago did that during his time a college and he did get done by the bank and it went to court.

I couldnt tell you the outcome though.

as cheeky says, it is fraud to write a cheque when you have no funds to cover it
Legal action is more likely to be taken by the person/company receiving the 'bad' cheque.
