Hi, i recently bought something from an online shop they emailed me an invoice and everything was fine, however the item has come and they have sent the better (and more expensive one) and sent another invoice for that and just deducted the money from my account which has now caused me to get a 30 pound charge as there wasn't enough in my account to cover that one. they say they will re-fund my money but does anyone know where i stand with the 30 pound charge, are they liable to pay. And if so does anyone know some law or something i can quote to get them to do it. i've got as 2 month baby and money is pretty tight at the moment. Thanks

Well I am not a lawyer but I am sure someone else will give a legal reply. My take on it would be this. When you ordered the goods a contract was formed. They agreed to supply the goods and you agreed to pay the price. However you did not agree to purchase a better item at a better price. If you returned the goods and asked for a full refund plus the thirty pounds then I think that would stand. The trouble is with on line shops, do you know who they are or where they are ? If so could you call them and ask to speak to customer complaints or something.
PS I think the law that you would be quoting would be the Sale of Goods Act - there is a section on 'ascertainment of price'.
