selling property due to divorce.

We have a property with a mortgage which I wouldn't be able to meet. What would come first. Filing for a divorce or selling the property. If a solicitor was involved then my husband I am sure would stop paying the mortgage and you never know how long a property will take to sell. What I don't want is to get my home repossessed for the sake of a smallish mortgage. Any advice please. I have seen a solicitor but forgot to ask this question

not a law person but in my experience you can file for divorce and will get the nisi
the financial side is then sorted and once that it settled you can then apply for the absolute

Well if you are legally separated before the divorce your husband could not just 'stop paying the mortgage', something would have to be drawn up so that he supports you. If it is only a small mortgage then are you sure you want it to be sold, it might even be awarded to you or most of it. I do not know your circumstances but don't assume you have to sell.
