My Building Society have increased my mortgage term by over a year because of arrears going back more than ten years. These arrears were disputed by me at the time the society notified me and they were due to the society's failure to maintain records.

Is this legal?

Yes it's legal.

With mortgages the lender has at least 12 years to pursue any arrears. The reason for the arrears - even a mistake on their part - is irrelevant.

If you are disputing the arrears exist then you need to provide them with your evidence - ie prove they are mistaken. If you've kept your annual statements it shouldn't be too difficult.
