Should They Inform You

I'm referring to clothes fashion only. Are shops legally obliged to inform you, and mark, clothes and shoes that are faulty. I ask this as it seems that lots of sale items seem to have faults of some sort, but have no notification of such on them.
Take a store such as TK Maxx who have a constant stream of designer labels on sale, and yes lots of them are last years fashion, but a lot I look at have faults, but again never marked up as faulty. Many of the shoes have scuffs / scratches. Most shops in the past did have racks of clothes marked as faulty, but you don't see it any more. Has the law changed , or was there never one at all?
