i suppose it drpends where it's going to. You probably wont get any of the charges that capital one have made over the last four months for not paying back because it's not their fault you did it wrong. How did you not notice over 4 months? Note to everyone: open your bills/statements and read them when you get them!
i assumed it was being paid

Never, never do this. Always check. Assuming things in financial matters is always a mistake.

You will probably get your money back, eventually. But it may have gone into someone's account who 'assumed' it was his and spent it. If this was your mistake (ie typed in a figure wrong) then yes you are legally entitled to the money - but actuallly getting it is another matter.
If the bank have put a trace on it you will probably get the money back eventually, but it could take weeks. We recently did a BACS transfer to an account number (somebody else's) and they gave us the wrong account number. Our bank got it back but it took around eight weeks.
However, there is a lesson here, and that is never, never assume that just because the money left your current account it has arrived safely with your credit card provider. Check all your financial statements with an eagle eye every month on the day you receive them.
