The test case hasn't been heard yet, I think there is still a few months to go.

Until this hearing, the Banks are not paying out any claims. You can still lodge your claim with them but they won't actually look into it until the outcome of the test case is known.

Thanks, think i'll send it in so its there and just wait.
Btw is it right that if i ask the bank to send me a copy of all my charges for the last 6 years they have too?
Yes. They are allowed to charge you for this (max 10) but I sent a cheque to NatWest to pay for mine and they never cashed it. They also have to supply you with the info within 40 days, unter the terms of the data protection act.

See here for a sample letter to use.
Hi, I am one off those people waiting for the out come I am with the Lloydstsb,I am with a Co; that are dealing with my case and they have informed me that the high courts are dealing with the case in January 2008. I had received details from my bank saying that they were looking into my case, 3 weeks prior to them deciding to hold payment, due to the court case

I claimed mine back myself, not using any company (who charge for it!!) Its really easy to do yourself, don;t pay anyone else!

I only sent 2 letters, the one requesting details of my charges and then one claiming them back. NatWest offered me a settlement the day before the hold was put onto claims, but I got paid 820 a few weeks later!
I contacted the Financial Ombudman about my charges and I got them back. You need to send them your bank statements showing all charges, Also write to your Bank telling them you have written to the Ombudsman.
