My father may possibly be inheriting some money from my late Uncles estate.

He is currently in the middle of a Trust Deed agreement (similar to an IVA in England) and my understanding is all the money would need to go towards paying off his creditors.

Does he have to accept the money due to him and if not would his share pass to my Aunt or my brother and I?

Thanks in advance.

I am unaware of a trust deed being similar to an IVA.....however if it is....then it shouldnt effect his inheritance. If however, he was filing for bankruptcy, then it definately will.

Which country does your uncle live in?
