phoned police this morning as son lost it and put holes in 2 (new) doors, and i was scared he would turn on me. they came, took statement, and i didnt press charges as his gf is pregnant and as long as he never came back,i was ok. end? so i thought, but no, the 2 cop bosses said it wasn't enough, so son has been in cell since 3ish.
What has made me sit here and really sob uncontrollably the last hour is that wpc phoned and said she is phoning my housing association and telling them about damage.
He should not have been staying here,so i will be homeless as i have breached my tenancy agreement. YES i do know I have brought it on myself, take that as read, thanks. I want advise please, do i press charges after all? do i tell H.A myself? will they really kick me out? what timescale? TIA, and upset enough-no sarcasm please-as said i know its my fault...

To evict you they need a county court order from a judge and no judge is going to give them one for something like this. Calm down and try to think straight , they WILL NOT have grounds to even apply for an eviction for this let alone get one. As to the row with your son, in cases of domsetic violence the police/CPS often proceed with the case even if the 'victim' wants...

Could you tell the HA he was only staying for a short while to look after you (or something similar)? I doubt they will evict you for this but they will probably insist you pay for replacement doors.
I don't know the answers to your questions, but I do sympathise with your situation. I hope it turns out ok in the end.
how strict are your HA? maybe they will cut you some slack if you explain things to them, a lot of HA's are quite amenable as long as over all you are a good tenant.

i told police i would pay for doors, I can only wait and see if HA will leave it at that, as Police won't.I am upset because of the HA as moch as anything else.
I'm surprised the police are calling your HA in all honesty
Why are they doing that?
This is similar to the plot of a programme on tv about 2 weeks ago. In that programme, the mother was given several warnings about her son living with her before they got to the eviction stage
I wonder that as well oj, the former tenants where I live were up to their eyes in trouble, the HA had no idea, they evicted them after months of non payment of rent.

Thank u God(??) Just got a phone call, from wpc, they have released him and she didnt phone HA, as i begged her not to-just the caution stands. I paniced as she said she 'had to' tell them.
I suggest you phone the wpc back and tell her that you wish to speak to her superior officer as you are not happy with the way she is handling the case, regarding contacting your housing association. If they insist ( can't see why they would) then tell the housing association that it was only a temporary arrangement in emergency circumstances and that you were unaware that they had to be notified. Also tell them that you will pay for the damage. I think it is very unlikely that they will evict you as they have to go to court to do that and a court would hear you out and base a decision on what is and is not reasonable, and if this is the only incident then it would not be reasonable to evict you if you had made the damage good and done your best to prevent a repeat of it. So sorry the police have made a very difficult situaiton even worse, but I'm afarid they're good at that. Try not to worry and take back control of the situation, you are not powerless.
they have no right to tell your ha. it is none of their business. they are to deal with your son, nothing else. tell them if they do so and you become homeless (you probably won't) you will sue. they have absolutely no right at all.
What are the terms of your tenancy/agreement with the HA?
Unfortunately there are two victims here: Bagpuss and the HA.
The HA has suffered criminal damage to their property and therefore are entitled to know. Although BP doesn't wish to press charges the HA will still be recorded as 'victims' and will have their wishes taken into account.

What is the background to all this ? I have only seen this post and it does not tell the full story . What led up to the row ?

Eddie-he crept into my room, (when asleep) 'borrowed' my card, and has had £300 worth of stuff off amazom etc over last week, just found out-told him to leave last night so he did it again, and got esa today but still overdrwn. he was in prison via me pressing charges last year, don't want to do it again, and anyway, told wpc today, and she said he shouldn't be here...
How are you going to keep him out from now on, bagpuss...?
whatever they do, you have the right to appeal to the HA!

and yes press charges!
Question Author
police told him to stay away, he can collect bag of stuff saturday when i have calmed down. I think i shocked him by phoning police, so he will stay away now
Do not worry about eviction it is NOT going to happen.
Tell the bank that someone knows your card details and get it cancelled NOW.
When you get a new card DO NOT tell him the PIN
Has the Amazon stuff arrived ? if not when it does send it back and get a refund. It has to come to your address as that is where your card is
registered. Has he got a key ? if so you need to get the lock changed .
I would report the 'borrowing' of the card as theft as that is what it is , but that is up to you.
But you MUST cancel the card, if he has made a note of the card number and the security no on the back he can use the details to buy more stuff online, there is a 24 / 7 help line phone for the bank to cancel the card. You can still get cash out by going to the bank in person until the new card arrives.
Question Author
Thanks eddie, will cancel it in a minute-phone charging. I didn't earlier as had 6 cards in 18 months and bank say no more, but piece of mind is better, and will go to bank, and ask if can have different account, no card.If they say yes, tm will be spent telling DWP and direct debits....
