i have been told by acas that i am entitled to 2 paid days off during my notice period, for jobhunting. my employer has been more than generous and i have probably had about 6 days off in this last couple of weeks. i have asked permission each time and it has been granted, but at no time has anyone said to me 'youve had your entitlement to time off, so you wont be paid for this day'. can they deduct it at payday? if they are going to deduct it at payday, should they have warned me?

Did you say "can I have a paid day off?"

no, i just said "can i have tomorrow off to go register with agencies", and "ive seen several jobs id like to apply for, can i have friday off to complete my applications" etc.... and the answer has always been 'yes, thats ok', but no mention of being paid or otherwise
If ACAS has told you your entitlement then I cannot see any reason to dispute your employer for deducting your pay for any over the entitlement. They may also think you are taking a day off your annual leave.

Since you have taken the days off just wait and see what happens.

Either way I am sure if you have annual leave left they would just allow you the two days entitlement and deduct the other days as annual leave.
