I had a tenant that owed two months rent so I served him with a notice to quit. He then came to my office and threw the notice at me and threatened me. I have three witnesess that saw this and they have given statements. he then came back and threatened me again. I sent my builder who is small guy to try and collect the rent and he went round four times and this tenant also threatened him. I then went round on the fifth night with two guys for protection. The situaion got out of hand and the tenant ended up with a fractured cheek bone and 1cm cut under his eye. I tried to stop but could not. I have excellent references and have been in the industry for 25 years without any problems and both my parents are disabled and I care for them. My business wil go and have 86 tenants that will have to rehoused as there will be no one to mage the properties. I was under a lot of stress at the time with my sister dying and being under medication.

I know a guy who was hit round the back of the head, completely unprovoked, by a lad with history of the same and he got a suspended sentence and community service so if you get worse than him there's something seriously wrong!

Good luck .. You are bound to get one or two a$$holes out of that many tenants.
I think the decision would be based on pre-meditation of violence on your part .. and intimidation from the tenant.
I would try and get satisfaction statements from maybe 10 tenants to show I was otherwise a good landlord.
were there any witnesses other than yourself and your heavies ? if not just deny and keep denying...any injuries could have been sustained before you arrived !!! circumstantial evidence and anecdotal on his part that you were responsible without any witness ! that would result in not proven in Scotland..a verdict not available in England, but without a confession or witness there is no case !

The witnesses are from my office at the time he came in, two members of staff and and a handyman. If I was charged with S18 then thats with intent but I managed to stay clear of that. I have already admitted my guilt as I cant put my parents through the added stress of a trial. I have alrady got many statements from my current and past tenants.
Don't want to give false hope here but I got attacked by my ex husbands girl friend when I went to her house to confront him about a personal matter. She broke one of my teeth and caused extensive deep bruising to my head neck and arms.I called the police from home and they came and took a statement, photos the works. They then arrested her.The CPS in their wisdom decided there was no case to answer as the only witnessess were her family (and they would side with her)and it was my word against hers.So fingers crossed eh.
