I recently applied for a government document, yesterday I received a response saying that I needed to prove my right to residency as I am a holder of a non EEA passport, the strange thing is I hold a UK passport, I can only assume they made this decision because of my country of birth. Can I complain as their comment is not based on fact but assumptions?

It seems pretty certain that you will have to address the matter by presenting your UK passport, or at least its details which will allow some government agencies to look up and verify them. Alternatively you could ask the Home Office to confirm your right to remain in the UK (giving them the passport details) and forward that confirmation - but they just...

It all seems very strange, Rockrose. There must be some sort of recourse.
Perhaps they have made a mistake - can you contact them by phone to explain that you have a UK passport?
It seems pretty certain that you will have to address the matter by presenting your UK passport, or at least its details which will allow some government agencies to look up and verify them. Alternatively you could ask the Home Office to confirm your right to remain in the UK (giving them the passport details) and forward that confirmation - but they just possibly may be reluctant to confirm or deny, in the well known UK fashion where so little is absolutely clear. If in your passport you are stated as a UK citizen then you should automatically be entitled to reside in the UK, although what passes for a system in the UK sometimes results in permanent rights "expiring" or disappearing somehow (some of the time the authorities themselves don't know, or are in some sort of catatonic state over things). Leave any thoughts of complaining until you arrive at a clear final position and then evaluate whether the authorities have acted shambolically (which may well be the case).

I’m going to phone tomorrow but I need to provide my right to reside document. Well as you can imagine the air was blue in this house yesterday! I can only think it has purely been made on my country of birth rather than any actual evidence.

I was born in a British colony’s to British parents so one would expect me to have the right to reside

Just a quick update - they refuse to accept that I hold a UK passport as apparently they have no record of this.
So I now have to drive for several hours to provide evidence!
