Roots going on to your property can be treated in the same way as branches overhanging your boundary and you are permitted to cut them off at the point they cross into your garden, hopefully not damaging the tree. You can commence legal action for any damage caused to your property though it may be best to speak to your neighbour first.

If you cut the roots entering your garden the tree may fall on your neighbour's property/house. Have a word with him/her to decide on the best option before doing this.
