Is He Liable?

My son has just found out that the company he has worked for for five years has not been paying his national insurance contribution. Also not paying his tax on his wages. He understood that they were deducted at source.
Will he be liable for this?

It doesn't matter if he received wage slips or not. The chances are the employer was making deductions and not paying it over.

yes he will be although not the employers ni.

He received his monthly salary directly into his bank account. Never given a payslip. Naive or what. He was taken on as an employee. Not self employed.
didnt he realise he was getting 30 pc more than expected?

Oh no. I would advise him to contact HMRC quickly and try and sort it out. I would explain to them that he wasn’t given any payslips during that time. Fingers crossed for him.

He was told his take home pay would be so much after stoppages. Trouble was his boss kept the difference.

Thank you all for answering this post. I advised him to contact the appropriate departments to resolve this situation.
What about the boss' wrong doing?
Complain to HMRC & employer will back pay & company fined....heavily!

wrong-un.
Did he really work for 5 years and never ever wondered why he wasn't getting a payslip? I find that incredible.
I've come across this before, we were "given" a company when the company owner went bust, just to keep production lines running at various motor manufacturers.
What is his line of work, David?
Not going to claim to be knowledgeable but, does he have evidence of the agreed contract ? If so it may indicate whether the pay had, had deductions that weren't passed on, or simply didn't get these things deducted at all. Which may have an effect regarding whether he's not paid them, or whether he has paid and they've been misappropriated.

He just has bank statements showing monthly salary paid in. His keenness for the job and naively believing His employer has sadly proved unfounded. Thanks all. Going now.
