Ok sorry, I don't know what happened there it missed my big speech. Urgh.

So anyway - my "friend" came to my house for a girly night + everything was going great until she just suddenly had a freak out. She threatend to kill me, my children + husband, my friend and then herself, then started attacking (biting) my other friend. I grabbed her in the attempt to try and get her out of my house, but she kicked me on the inside of my ankle and I went crashing onto my kitchen floor. Thankfully my husband and friend managed to get her out of the house, but she then went to my neighbours and smashed their stained glass window. Someone called the police and they put her in the back of the car, she jumped out, she did this several times until another friend turned up + offered to take her home. No charges were made and no crime reference number was given. BUT - I went to hospital next day to find she had broken my ankle + fibula, I had to spend 4 days in hospital as I needed surgery to my ankle to insert screws. When I got out of hospital I rang the police to get a crime reference number as my husband wanted me to claim compensation from the CICA. To my shock they arrested my now ex-friend and have since charged her with GBH. Never in a million years did I think this would happen, I was angry and yes felt she should be punished but I feel terrible that it such a severe charge (call me naive but I am truley shocked). So really I would appreciate any advise on what might happen to her, she was a perfectly upstanding member of the community, never been in any trouble before, held a very responsible job, and blames the entire night on alcohol + says she doesn't remember anything at all. She has also been to my neighbours since and paid them to have their window fixed.

wow.. and she's never done anything like that before? has she never had alcohol before? even drunk, that is wild behaviour.

if you're asking about possible sentencing, I don't know, but someone will advise you if you repost the question under "legal/criminal". I can only suggest she gets a good legal representative for when she goes to court. I assume she will plead guilty, for which she will get her sentence reduced by a third. it would also be wise for her to get herself onto an alcohol awareness course.
you cant be serious that you wanted to report her so you would get compensation, but didn't want anything to happen to her?
If that were the case, people would be doing it left right and centre - i fell down the stairs and broke my leg 3 years ago - could i have claimed my husband did it, but not expect him to be punished, but still get a nice fat juicy cheque?

so you wanted to claim for criminal injuries but didnt want her to be charged as a criminal.

either she is or she isnt, you cant have it both ways.

They do, this is one of the many many reasons you never see the police patrolling.

there are varipus types of GBH so no-one will know what shes likely to get.
if she gets found guilty of GBH (do you know if it's sectio 18 or section 20?) she will most probably get a prison sentence - if you do a search through law for buenchico's answers he often refers to a chart that has the sentence guildlines in for GBH

It may be that the compensation system is set up to charge costs to the criminal.. and she would be forced to pay you directly...
Have to say I'm quite surprised at your train of thought - that you didnt want to get her in trouble yet you want financial recompense for her actions... How is it CICA should cover this cots and not her!!! Think about it!!
can i ask - how old is she???

I haven't actually said I didn't want to see her punished tho? Im just suprised it was GBH she got charged with. I don't know how CICA works, so maybe she will have to pay compensation.

you cant say you dont want her punished but then claim for criminal damages / compensation.

I would expect the CICA would only pay out if there was a criminal and for that she would have to be found guilty of a crime.
