i sold a pair of sunglasses, in perfect condition, brand new with tags and labels, on ebay.  I sent it well packaged, cushioned etc, but not special delivery (this was offered to the buyer but not taken up).

I got this email on monday:

"The sunglasses (ebay item xxxxxxxxxx) arrived on friday. Both lenses are scratched around the bottom, and one of the arms is hanging off. I bought them for a xmas present, and obviously wouldn't dream of giving them now"

the person has perfect feedback, what should i do, ignore it (as i know they were ok when sent), refund them or tell them they should have requested special delivery?

Ask them to provide you with a photo of the glasses shown the damage, and also ask them for a description of any damage to the parcelling as you are going to go to the Royal Mail and take it up with them....also inform them at this point that they will have to then most likely post the glasses back to you for you to persue a claim with the mail......If they are trying it on then this should put off most chancers...If they have a genuine complaint then they will be happy enough to comply.

You could always just inform them that they did have the option of taking insured delivery and that the glasses were in perfect condition when they left you so you have no legal obligation to do anything.....This will most likely involve the swapping of negative feedback for both parties which you can then take up with eBay.

It really all depends how you see it....I would contact eBay for advice and see what they have to say on the buyer.....Good luck either way.

check in terms and conditions on ebay.it may say who the liabilty lies with

This sort of thing happened to me when I sold a PC on Ebay to a person in Northern Irelend who also had perfect feedback.

I had real problems getting this sorted and ended up losing the pc and also I had paid for postage etc. Ebay were crap and had no interest in sorting it out, all I can say is that its a lesson learned for me.

The guy in NI was obviously scamming me as he gave all sorts of excuses about why he could not prove damage etc.

Sorry things did not work out for you.

I stay claer of ebay but do sell on Amazon market place. My approach is to believe what the person is telling me. In such situations I would just issue a refund as the cost of the stuff I sell is low when compared to my 5 star rating (The maximum on Amazon) but it depends how much the glasses were sold for. Sometimes what I have done is sent an empty stamped envelope to the buyer saying that if they are unhappy they can return the item. But in your case I would send an e-mail saying the glasses were sent in perfect condition, you were offered special delivery and declined therefore you cannot accept responsibility, an offer for a refund on return of the items would not be declined by a genuine buyer in my opinion.
On other thing as they have said that the item is for a christmas present they can't claim this has put them at any loss or embarresment.
