we er going to magaluf on the 2nd oct my husbands passport expires on the 31 st of jan 09 and mine on 20 th march are they valid to travel

Yes. EU countries accept valid national ID cards from all member states with no minimum period required.

Yes, they just have to be VALID. So in theory you could fly into Spain on 31st Jan and your husband would be allowed entry. You wouldn't be able to get back into England though......but I am just proving a point!

The UK doesn't have much option but to allow its own citizens in with an expired passport. OK they can make things uncomfortable for you while they check things out, maybe even fine you, but they can't refuse entry
