Can anyone help me.


I have recently pleaded guilty to a posession charge of a class A drug I am at present on a deferred sentence. This is my first offence.


I have a wedding present of two weeks at a friends house in Florida, what are the chances of me getting into the US....should I declare my conviction or not!!!!!

If you declare the conviction you stand no chance of getting in under the visa waiver scheme. You are supposed to apply for a visa which you may or may not get - particularly as the offence is recent.


If you don't declare it it will depend on whether US immigration know about it. I have no idea whether they will or not.

drugs offences are what the florida customs men deal with most,i doubt whether you will get in,either on the waiver or applying for a visa,if you go and lie,they will throw you back on the next plane.

I don't think the US customs have access to criminal records and it's up to you to declare your conviction or someone to tip them off.

Since the drug offence related to possession, rather than distribution, of drugs, you might not be denied a visa. The problem is, however, that it takes about 4 months to find out whether your application has been successful.

PS: The US immigration authorities don't have full access to the UK criminal records database but some information is automatically shared between the two countries. This will almost certainly include more serious drug offences but whether or not your name will have been passed on or not depends upon where the authorities determine the cut-off, between minor and more serious offences, to be.
