With your legal background I thought that you would have remembered that the difference is important!

If it starts soft and goes hard (and we're not talking about anything 'naughty' here!), it's a cake, so there's no VAT on it.

If it starts hard and goes soft, it's a biscuit which attracts VAT.

What about yogurt? Soft when its fresh and soft when it's soft when it's gone off, or doesn't that count?

What about soured cream,thats gone off before you start,,mind you so have most cream cheeses come to that.

Chris, it's gone 9, I've had a long and difficult day and frankly the "Jaffa Cake" case has never impacted on my world because a) I hate jaffa cakes and b) I don't practise in the world of jaffa cakes and c) I always bake my own cakes and biscuits!!!!!

Chris, you have confused me for the first time ever. Sometimes it starts hard and goes soft, and at others vice versa, so is my willy a cake or a biscuit?

Hi Janzman - doesn't everyone? (My husband gave it to me on our first date when we were at college and he couldnt afford champagne - think Crunchie was advertised as the champagne bar (or something similar) at the time.)
