If convicted under the rules of joint enterprise all will go down as murderers. While it's difficult to have any sympathy with them, those who engaged in horseplay and now find themselves facing murder charges must feel themselves hard done by.
Any thoughts?

Horseplay seldom involves knives and stabbing.

People need to be held to account and not excused by social reports, lawyers and courts.
hardly horseplay, a man has lost his life because of these little savages.
They all would have known weapon(s) were being carried. 15 years apiece would be appropriate.
Interesting to look up BAILII is a good site

erm thoughts? Worse in Spain. Doctor wimp stayed in his hotel whilst his adventurous pals broke up the town, and he was indicted and convicted on joint emterprise ( obvio culpabile)
and then
had to come back and tell the GMC why he had been convicted ( a certificate from the juez ( who?-ayth) was sufficient GMC rule diumpty dum)
and successfully pleaded that ( altho another rule says that you specifically CANNOT ) he didernt.....

cannot plead that the certificate isw rong - there is another rule that certificates from judges cant be wrong - ho hum es un moondo funny
I was astounded the plea - this certificate is wrong - succeeded when another rule said - the certificate can never be wrong
and on the beeb

since there are alternative charges ( accessory before the fact now assisting an offender I think) - they are specifically saying it was a joint enterprise

The case that astounds me is the teenager who got stabbed in another case was carrying a knife and the defendant still got convicted of murder
They all would have known weapon(s) were being carried

this is called transferred malice for anyone er reading this.
the knowledge of a knife is enough to convert manslaughter ( it was an oops, honest) to Mairder ( die die damn you!)

law on this is VERY technical
Lie down with dogs, wake up with fleas.
Yes, nothing wrong with mutual combat, pp, is there?

Dry your eyes, Sandy. It's not like the scrotes will be breaking rocks or anything for the next 25 years.
// 15 years apiece would be appropriate //

This has made my day. And it's not even 9 'o clock.

Such a submission is worthy of praise!

It is an admission that Capital Punishment is inappropriate, even for these would be young murderers.
I am puzzled by "what a world we live in" - joint enterprise is nothing new. You seem more concerned for knife wielding yobbos than the victim.
//It's not like the scrotes will be breaking rocks or anything for the next 25 years. //

More's the pity.
//even for these would be young murderers.//

Nothing "would be" about it Zebu (you are trying to sanitize murder again) - there actually was a murder!

My comment re sentence was based on our existing laws - not what I would like them to be.

"15 years a piece" is testimony to a relaxation in your attitude towards murder. Good for you.

I hasten to add, I take no credit through any of my previous postings for your conversion!
I suppose you would give the young scamps a lollipop each & tell them not to be so naughty in the future?
There are parallels with this - albeit a fictional film.

https://en.wikipedia.org/wiki/The_Boys_(1962_British_film)

//Ginger is acquitted. Billy and Barney are under 18 and are to be held indefinitely at Her Majesty's pleasure. Stan, being 18, is sentenced to death.//
//would be young murderers//

What a stupid thing to say. They didn't try and fail. They ARE murderers.
// suppose you would give the young scamps a lollipop each & tell them not to be so naughty in the future? //

There are by far, many more people than me who are qualified to work out what is deemed to be an appropriate sentence for this type of crime.

Notwithstanding the Judge handing down a sentence of less than 10 years 'a piece', then knowingly assured it won't be the death penalty, there will be no complaints from me!
// They didn't try and fail. They ARE murderers.//

Horseplay was given at the trial in their defence.
