Virginia does have the death penalty apparently they can choose between lethal injection or electrocution.

First of all, there has been no investigation into the motives of this individual - he could be suffering from a mental illness and not be responsible for his actions.

Second of all, murder by the state is still murder, the fact that Virginia actually has a choice of methods simply adds to its appalling approach to law, punishment, and humanity.
He's been charged with Second Degree murder and there is no death penalty for First or Second Degree murders only Capital murders, it seems.

of course, eddie, I sometimes forget that the US has degrees of murder rather than manslaughter etc. No doubt he'll be able to successfully argue that he did not intend death.

Normally I would be in agreement with Capital punishment for this sort of crime. However in the US they have a real big problem that has not gone away since the civil war, executing this man would undoubtedly lead to him becoming a martyr and could well consolidate the South's odd opinions.
TTT....you have admitted today that you break the law on Motorways, and you have made it quite clear that you disagree with Law, when it comes to the result of the Hillsborough Inquest, and ongoing trials.
TTT they have manslaughter in Virginia but the categories of murder depend on various things such as the method used and the age of the victim and the perpetrator.

I was referring to this question. I thought you were saying that I somehow disagree with the US murder law. I take there are no laws you disagree with then?
I would never vote for the reintroduction og the death penalty.

Re this case then it's up to the State of Virginia to decide under their laws.

I don't think he should be executed, but now I need to find out what 'second degree murder' actually is.

Deliberately driving a car at 40mph (as reported) into a group of people would suggest first degree murder...but what do I know.

Second degree murder is described as "an unpremeditated killing, resulting from an assault in which death of the victim was a distinct possibility."

First-degree murder is defined as "an unlawful killing that is both willful and premeditated, meaning that it was committed after planning or 'lying in wait' for the victim."

I can see how this was second degree.

If found guilty, I hope this individual is put away for life - and in the U.S. we know what that means!
The gaol term will be from five to forty years if found guilty.
It wouldn't bother me if was executed.
Hopefully the scumbag will have a long and horrible existence inside the lovely US prisons.
