Hello all, maybe somebody may know the answer to this. On monday i was involved in a car accident. It was caused by a third party. The third party hit a car and the car infront of me swerved to miss the car that the third party hit, Basically, the car infront of me swerved left, then back into my lane and ive gone into the back of him. Any ideas on how this will pan out?

Cheers,

Prepare to be held at least partlye rersponsible. If you hit a car, then you are deemed to have been travelling too close, too fast. It's the law, but they may look at the mitigating circumstances, but be ready in case they decide you have to claim your own damage of your insurance, or pay for it yourself.
I'm afraid that this will be treated as 2 accidents, the car in front swerved out and then back. It must of had room to get in front of you again, therefore you where behind. The third party caused the initial situation but peripheral to that you ran into the back of the vehicle in front. As Andy says to be in that position you must have been too close or too fast. If you hit the car in front 99% of the time it's your fault. You'll do well to avoid being claimed off of by the person in the car in front. Did the car in front run into anything or was all the damage to the rear end? If they offer K4K take it.
I'm not a lawyer but i think you might be ok... My insurance appointed a solicitor within a couple of days so ring and discuss with yours.
We had a similar thing, but without the swerving problem, and the original accident was seen as the cause of ours. We were not considered responsible despite hitting the car from behind.
However every case is different so would advise making a careful statement now so that you can be consistant and accurate when you are asked. Hopfully that can make the fault clearer.
Good luck - hope that you are ok?

hi chaps, thanks v much for your thoughts. They are pretty much what i was expecting. At the time of the accident the lights had just changed so traffic was only just picking up speed ie 15-20 mph. What is knock for knock for knock l/head?

At least there were no injuries!! only financial damage to come by the looks of things!
