witness statement against me

I was driving along in the left hand lane on a 1 way dual carriageway and wanted to turnright into a side road. i slowed to almost stationary and had my indicators on. I checked my right hand wing mirror and saw the road was clear so began to turn. The next thing I know I was hit in the rear by another driver, who sent me spinning in the road, up the path and left me facing the opposite direction with the back of my car planted firmly in a wall. I was fully aware of what happened and that I was not in the wrong, the other driver said they had no idea what had happened. I am sure that they were exceeding the speed limit and have photographs of the tyre marks which start several yards before the collision spot. A witness has said that I pulled out infront of the other driver but what they are saying happened is not possible and I believe my photographs taken the following day prove this. Do I have a hope in proving the other party are liable? Or does the witness account against me mean my pictures and account are worthless? What can I do next?

I got stitched up like that some years ago, in an insurance case. A vehicle behind ran into the back of me and produced a "witness" who was supposedly walking by. I exchanged details with the other driver and we both drove off together - they never spoke to anybody by the side of the road, and I certainly never saw anybody there,so where did the witness come from?

Didn't do me any good that they were lying in their teeth the pair of them.

The driver who went into me was a driving school instructor in a family business, so had a very heavy motivation not to be found in the wrong.

They even gave this supposedly independent and unbaised witness a lift to court and a �handshake" afterwards, laughing like drains. Sorry about the "�" there - that was a typo.

But one v two was not good enough....
you may need to clarify this.

you were in the left lane, a car attempted to passon your right, and you turned across his path, correct?

i think that would usually go against you anyway, regardless of whether you were indicating or not.
one more thing, if you checked your wing mirror but not your blind spot, then he may have already been there when you began to turn.

if the other driver had been travelling at excessive speed, he would probably have had time to see you, and the tyre marks would be longer.
