Been charged with gbh with intent after a fight involving 12 or so people behind a rail station. We had 7 they had 5 or 6 and we were giving them a well earned tanning from an earlier incident. What happened next was the one police just appeared, and seen me hitting this lad with a baton/extender and it took out most of his front teeth, severed his lip almost off, all from just two strikes. Pretty unlucky that they witnessed this as its not an area covered by cctv, but thats it. I have 5 incidents on my record, but no jail time and I'm hoping to avoid again. The lad didn't press charges, states he just fell, but this copper saw it, which is the issue here and i was arrested running off.

Ill be getting a solicitor in the morning, have funds for a good one.

Personally the boys think I may go down this time, but no witnesses will come forward, just that one copper and who knows if they will be able to accurately recall. We've had similar situations but never a witness like this. What chance for jail time do people think?

(I don't care for any *** judgmental ***, we all live our lives how we do, and the lad injured was game.)

Bad luck. The jury are going to be asked why a passing policeman a)did anything b) invented a story, assuming by then you've decided on a different version. The officer will have made a contemporaneous note; there's nothing vital for him to forget come trial.

And, rest assured, the police will try to find the 'game lad' if they haven't got a statement from him already. They'll tell him not to worry about things they didn't see, in case he's worried about being prosecuted.

Yes, that's my concern. Looks like bad luck and probably not recoverable. Ill go down fighting and take whatever on the chin.

Am guessing Hartlepool or Hereford?

Was this a ruck between two sets of football hooligans?

If so then I've no problem if a load of meatheads who get off on kicking the sh1t out of each other as long as it's in an isolated location away from the general public.

Sounds like you've just been unlucky that the copper saw you, especially as the injured guy isn't taking it any further.

As it's your 6th 'incident I suggest you give it up before you end up spending time at one of HM's holiday camps.

You can only go to the well so many times before you eventually fall in.
The chances of going to jail - is that going to jail or going back to jail ? are high.
and as usual it depends on the facts at the trial.

.
Kloofje - you spent too long in gentle Sarth Efrica

This sounds a bit like Chard (somerset notably NOT under water but should be ) where people go specifically to drink and then fight. No drugs, see ? But I dont think there is a railway station there. There are people who go out to drink and fight. Go to Canal St Manch - there they go out for a drink and then start kissing each other. Chacun as they say....

It is not so much jail yes or no but how long.....

I think you may go down for this fight, and maybe it will make you stop and think that you are very lucky nobody got murdered and ended up on a mortuary slab.
There is no "may" about it.

If convicted of a Section 18 offence - especially one such as this which "... took out most of his front teeth, severed his lip almost off" immediate custody is as about as inevitable as it gets.
