section 47?

As i was leaving a pub on sat night i bumped in2 this guy,comments were made & i felt thretaned so i punched him (stupid i no). This lead 2 a brawl inside the pub which saw this guy get me up against a table full ov emptys,on which i leaned & grabed 1 & swung for him in self defence ,i did NOT touch or cut him with it. I then left the pub & was aressted up the road.

After a night in cells i was interveiwed & so so,but the o.b said that after i swung out with the glass a woman community warden went 2 split it up & i've swung for her,also NOT touching or cutting her but she had tiny glass fragments in her hair! This i do not remember & is toatly unlike me 2 do so.

I've been realised on bail till next month awaiting cctv & further interveiwes with the man/woman & bouncers. I've admited 2 throwing the 1st punch & to being drunk but cart remember much else about the warden inciedent untill seeing the cctv 4 myself.

This is my 1st offence & i have an excellent job & small family & would loose my job if convicted,as far as i no neither was injured at the tme only myself having cuts 2 my head/face/lip & hands. Can anyone shed any light on witch way this could go??? Cheers.

make sure you get a good solicitor and get as many character referances as possible if you havent been charged yet sre you on bail friends son admitted simlar thing and basically the barrister has told him he has hung himself for being honest so do not admit to anything and please get a good solictor he charges may not come to anythng but it could be assult and this carries minimum a fine or taggin or custody or comunity service this is not gospel this is what we are lead to believe sounds to me like the cps and the police are trying to gater enough evidence tgether before they take it any further best of luck mate hope things work out for you

Nice 1 cheears suse. What is it that your freinds son do,did he actualy glass some1 in self defence or just go & miss the victem? & what was the out come ?

he was being goaded all night out by a group they approached him pushing him and he struck out with glass in hand addmitted it immediatly and was no trouble for the police first recorded words from them are i didnt mean to do it not sure wat outcome will be will keep yopu posted hes been charged with a b h got court end of the week

you would have to show that the threats constituted you being in 'fear and alarm of life and limb' and you reacted in a manner to defend yourself in proportion to the preceedng attack. For a defence of self defence to be successful you really need to show that the actions you took were immediately in response and of a like manner to which you were subjected to. I doubt you could show this as you were only verbally threateneed and you physically attacked the assailant. i know this sounds harsh but that is the rules of self defence. also, if there is the option of retreat- ie. moving away or leaving you have to show that his is impossible for a successful plea of self defence.
