Can anyone help? I have been charged with a section 20 and would like to know if anyone can help or shed some light. My Background: Well Educated; Professional Job No Previous convictions only motoring convictions Scenario Whilst at a party a drink was stolen from our table I watched the person take the drink from the table in person. I attempted to find the person with no joy to verbally confront him about taking a drink not belonging to him. About 20 minutes later i was smoking outside and identified the person. I was not drunk and had consumed 3 pints of lager that night. After confronting the person i was verbally assaulted and threatened with a waved fist by a person i described as being drunk. (He has admitted to consuming 8 pints of lager and a glass of champagne) In fear that i was going to be struck i attempted to push the person away. I have caught the person in the head / jaw resulting in a fractured skull. I did not intend to cause any injury however i have been charged with a section 20 GBH. Any advice on the possible outcome would be appreciated

Ah yes, the amount of times i've pushed someone away and they've fractured their skull. It always happen just like that.

The amount of times that tetjam has posted anything useful / constructive is minimal (NO, I'll change that to non existant) but you know, on this occasion, I believe his/hers post to be appropriate.

I'd also like to remind you that Jeffry Archer, Jonathon Aitkin and Charles Brocket (remember them)? were all well educated...as if that has anything to do with it...proffesional and no previous convictions but away to clink they went. Why do YOU think you are any different?
I've met plenty of 'upper class' types in jail and believe me, they dont have it easy.
Ive had plenty of drinks nicked in my time but I havnt made a scene about it. Guess it must be a big thing to you?
You are going to jail my friend and I hope it is for a long time....someone nicks a bit of lager and you fracture his skull?? get a life you f****g hooray henry.

Ever see that documentry some years ago about 'toffs' in prison? God, I actually felt for them. What with been locked up with working class folk an all( albeit criminal working class folk). It must have been terrible. Having to read the Sun instead of The Times and having to shower in front of someone from a council estate instead of someone from cambridge after a rowing match...my god the indignaty.
And having page 3 pictures on the wall instead of the latest piece of totty to emerge from the royal family....princess anne flashing a piece of leg as she emmerges from a car to plant a tree, etc.

let me see now!
The first time that I went to prison was for affray (later commuted to a probation order) and I never hurt anyone and was acting in self defence.
The second time was for ABH (a lesser charge than GBH),
where NO broken bones were reported (I got a reduced sentence of 8 months because of mitigating circumstances)
A charge of common assault...3 months
and a few little unimportant sentances in between.
AND YOU....knackered someones skull???

having said all that, do you remember the "coughing major" on who want to be a millionaire? Tried to swiz the show out of its million. When he was up in court the judge said that he wouldnt send him to jail because he would find it difficult...my heart fukcin bleeds. Anyone from a working class background and they would be doing a long stretch for that. Some times you toffee nose tw@ts DO get of with things. Hope not this time though.

I think you should consider yourself lucky that you have only been charged with a section 20 and not an 18.
My partner was found guilty of a section 18 and got 6 years. The 'victim' attacked him with a knife and ended up with a fractured skull, after my partner hit him once with a piece of wood.
So my friend again count yourself lucky but i would also say to you that you are definately going to prison probably for around 3 years. Unless of course you can convince a jury that you fractured his skull by pushing him away lol!

It depends on if you've been charged with section 20 intent or without intent, as the other person didn't hit you i can only assume its with intent and that will be a bit more difficult to prove you were acting in self defence. If you plead guilty from the start and show remorse on what you did then they do take this into consideration, they will also take into account your background as well. The judge maybe lenient on you and you could just get community service. The maximum sentance a section 20 carries is up to 5 years in prison or a £5000 fine.
