Can anyone explain to me how comes I have been asked to pay back a very substantial amount of money from my ex employer.

It say a couple of awol days in two months of last year, full sick pay and half sick pay. I was pregnant last year and ill alot, but I had certificates for that and any sick periods over 7 days.

I left them after 17 months

Tell them to "shove it" and take you to court if they think they have a case.

Mentioning 'Sex Discrimination' may put them off.

Hi rishyrish,

Check your contract/employment handbook if you have one. It may be something related to your maternity pay, can't remember the exact details but I think if you have had additional maternity pay and then not returned to work, they can ask for it back. As I say, I'm not exactly sure of the details, its only a vague recollection I have. Because somewhere I used to work, used to retain the additional payment until the lady returned and then it was paid as a lump sum, this was so that if people choose to stay at home the company did not have to claim the money back.

I'm sure someone else will be able to put me right if this is completely wrong though!

If all else fails try the citizen advice, they may be able to find out more information and point you in the right direction.

Good Luck - let us know what happens!

Sorry the awol, sick pay etc are the reasons they want back over 1600. I will have a look in my contract but I didnt even get additional mat pay. I was back at work when my baby was 3 months! Thats why I cant understand why it says full sick pay for the reasoning

Hya.

I believe there is a stated case about repaying overpayments. Try Googling "Law of Estopel" and see how you get on

regards

There is madjack but I think thats different from this case. This isn't a case of them mistakingly over paying you but them asking for money back which was paid sometime ago.

I'd definately go to the CAB and tell they former employer you are seeking legal advice on the matter and will contact them shortly, that may mean they back off.
