seatbelt laws in wa state

recently my son was pulled over by the wa state patrol...he had on his seatbelt..however the patrolman said the "shoulder strap" wasnt tight enough..too much slack..ive driven this car before and the belt does tend to loosen up a bit after taking off...but still works and goes tight when pulled on...can we fight this ticket? is it against the law to have some slack in the shoulder strap? help anyone??!! can't find any specific info regarding this !! thanks

can't help with wa law but if inertia seatbelt is used it should spring back to properly fitted position
