Responsibility For Household Rubbish

At what point does the responsibility for household rubbish move from the householder to the collector (usually this is the local authority)? The collectors in my area stack the black bags outside my house for placing in the vehicle when it arrives, but if for any reason the operator thinks a black bag contains non-household rubbish such as garden waste, building materials etc. even if it doesn't, the bag is left in the street. Who is now responsible for the contents of the bag?

In addition, on occasions the collectors miss out my road meaning that bags are just left in the street for the next collection, usually a fortnight, unless the householder retrieves the bag. Is the householder still responsible for the contents of the bag even when a collection is missed?

responsible how? I don't really understand your question - are your rubbish bags going to explode or something?
if the bin men miss out our road, i just phone the council and they usually come the next day

Oh, if only life was so simple! Where I live the council doesn't respond to calls to collect rubbish the next day when they miss a collection, you have to wait for next collection day in two weeks. Presumably I can leave my black bags out for the next two weeks on the off-chance that the council collect them. Or do I bring them back into my house, having been out on the street all day for dogs to urinate on? Are the bags still my property if the council do not meet their obligation to collect refuse?

If you live in a terraced house you have to keep them in the back yard, wheelie bins are not supplied as they would have to be wheeled through the house and the council won't empty them anyway, they only accept black bags.
Britlion your council is the exact opposite of ours plastic bags are banned and only rubbish in the correct bin is collected. We have 3 bins and 2 boxes for rubbish. Black bin is general recycle waste, Brown bin food /garden waste, Purple bin non recycle waste, 1 box for newspapers and 1 for cans and glass. Leave a black bin bag in the black bin it won't be emptied and you have to wait another 2 weeks.
i must be really dense here - if you can keep them in the back yard till bin day, what's the problem? from your post it sounded like your only choice was to bring the rubbish into your house or leave it there if they don't come. What do your neighbours do?
