Can I Get Out Of My Mobile Phone Contract - Did Not Sign The Contract In Store...

I got a new phone in December in store (3 UK). I selected my phone etc but did not sign the contract, I received a call the following day informing me that they needed the signature and could I call into the store and sign. I did not and have not.

My phone is not what I had hoped (windows) and if I can I would like to change back to an android phone.

Can I get out of this? as I haven't signed anything...

no, by using the phone you have accepted their terns and conditions
Have they been collecting monthly payments from you? Did you since a DD agreement?

I think I signed the DD agreement and they have been taking the payments. I did not sign the T's and C's agreement though
I expect that by signing the DD, paying the DD and using the phone would be interpreted as agreeing to the terms
