Another year and another problem with fencing.
My neighbough (he rents his house out) had a new fence put up last year and they didn't make a very good job of it.

The first winds after it was put up loosened the posts and then one fence panel totally came adrift.

After the winds of the last couple of days there are now two more panels come away from the posts.

The young lad who lives there now is oblivious so it looks like we are back to taking the pooch out on her lead again in all weathers.

Gripe over.....

maggie, there is nothing to stop you putting your own fence up on your side.
Maggie..a fence is only as good as the supporting posts. I fenced a long garden and it would take a bomb to shift the posts.
I moved here in 2011 and there was a new fence wobbling along one side of the garden. The chap next door proudly told me he had erected it. It will be down soon so I shall use his panels and new posts to do it properly. Can you do the same as it's a new fence?
You really shouldn't be relying on your neighbour's fence to keep YOUR dog in the garden.
"The young lad who lives there now" is no doubt hoping that you'll get fed up before he does, and you'll get the fence fixed - at your expense, of course.
It's not the young lad's place to fix the fence, it the landlords. Maybe you could get I touch with him?
Ours is fine... At least it will give my brother some work! Between fixing broken fences and clearing snow (well not this year so far) he usually does not too bad during the winter.
Mine is on its last legs and we have just had a quote for £1,200. for a new one.
Just what we need this time of the year.

Thanks Daffy. I dont rely on his fence keeping my dog in. It would just help. It is his fence not mine and should be maintained whether I have a dog or not. Glad you are not my neighbour

There is no point putting a fence up my side with his one banging against it
But it would keep your dog in.
maggie, if that is the case your neighbour is fully entitled to take the fence down entirely and not replace it. Or replace it with something that wouldn't keep your dog in.

Mine is blowing left and right like mad! Found out that the posts havent been put in deep enough, so need to get the whole thing repaired.

Well my dog is 13yrs old so she onl goes out for a quite wee so is not really the problem but the fence is.

When I bought my house it states which fence belongs to who and that you are responsible for keeping it in good order. That doesn't mean you take it down if you can't be bothered to maintain it.

Keeping it in good order can mean taking it down. There is no law that says houses must have a wall or fence between the gardens.

Your options are: Contact the neighbour and ask him to fix it.
Contact the landlord and ask him to fix it.
Put up your own fence on your side of the boundary.
Do nothing.
daffy is correct. Your neighbour's only responsibility is to ensure the fence is not in such a bad state of a repair that he can reasonably foresee that it might injur a third party.
Just put some chain link fencing up on your side. That will keep the dog in. We have put a fence up just a few inches inside of the boundary fence so that we can't see our neighbours. Is there anything stopping you putting a fence up.

Daffy there might be a local by law on the houses concerned that says fences have to be maintained and kept up, regardless of the law of the land, which you have quoted. If so it will be written in the land registry/deeds.

Having said that I agree the best option is for maggie to put a cheap fence up on her side for the sake of the dog.

Thank you LoftieLottie that is exactly the case.
Having just had my boiler go down and having to replace it, a new fence in not on the agenda at the moment unless of course my own one goes down.

Thanks for the replies. Fences are just one of those things which are a pain in the backside and no-one is 100% sure what the law is regarding them.
