hit by lorry who drove off...

My boyfriend was hit by a lorry few months ago in his car.
they were merging and the lorry just drove into him.
However the lorry driver drove off.

He got a witness and the reg so able to find him.
The witness even said it was him in the wrong.

However now insurance company are saying may have to do 50/50 on insurance?
Surely if he drove off then this is guilty conscience.
And as we got a witness to say aswel?

They're just saying be easier to do 50/50 but that means we have to pay half of excess for something that wasn't his fault?

It just doesn't sound like the insurance care that much about it and it's like easier for them to go 50/50, but it's money out of out pocket.

What can we do?

Don't know about your question, sorry. But let me guess.....I bet the insurance company was "More Than" (In my circles AKA "Less Than")??

Haha no it's actually elephant-all the same though!
you dont actually say which vehicle was merging with the traffic flow,if it was the lorry then he would be at fault as most places where vehicles merge are at giveway details...even motorway slip roads where they joing the motorway are give ways(see the highway code) if however it was your boyfriend merging,then due to the size of the lorry and its amount of blindspots on the left hand side of the vehicle he probably didnt even know he had been hit.
A lot of car drivers tend to force their way out on these slip roads and are quite cocky that the vehicle will give way to them whereas with lorrys if they dont know your there then theyre not likely to move or stop for them and the blame cant be placed at the drivers actions,,,give way means give way to oncoming traffic,not take it for granted they willmove over or let you out
