will a recorded conversation stand up as evidence in a court of law.? boss is causing harassment but always without a witness.

I might be right in thinking it will only stand up if the person who is being recorded knows they were being recorded at the time

thanks 2375J I had a feeling that would be the case, which makes it impossible to prove what he says , as if he knows he is being recorded he is going to be careful about his wording.

thanks anyway infomaniac, it does look like US laws.
do it anyway...an then tell him you have...the threat of that alone migth be enough to stop him

also if it has a jury, knowlegde of a tape, whether they hear it or not, is evidence in itself
i think an employment tribunal is different from a court of law anyway. you need buenchico to answer - he seems to know what he is talking about when it comes to taping coversations

one is allowed to record any conversation in which they are a party and it can be used as evidence in court if allowed by the judge hearing the case. Proving it was your boss speaking may be a hurdle so be sure and identify the parties on the recording
