I've got a football banning order section 14A of the Football Spectators Act 1989 which was given to me at Magistrate court when I was 16, (18 now), it was a civil case and not a criminal one. So with this in mind does receiving the ban create a criminal record and if so will it show up on a CRB.

Thanks in Advance!

Evidence to support your Yes? Just I've been in contact with a Solicitor and they said it is not a criminal conviction. Which means no criminal record.

So how did you come up with the conclusion?

thanks

This Home Office website categorically states that football hooliganism is a crime.

On that basis crimes will show up on a CRB.

Maybe your solicitor knows a loophole.

Good luck.

football banning order section 14B of the Football Spectators Act 1989

Section B not A.

Section A is Criminal case and Section B is Civil.
That won't show on a CBR check. Anyone who commits an offence (as serious as this in question) will have their records removed at the age of 18. I did something I'd rather not like to talk about at the age of 16 and the police have absolutely no records of it. I have also had a CRB check and it does not appear.
To add to the above:

I know they don't have this information on the police database because: I faced magistrates in 2005 and they told me they had no previous records for me breaking the law.

I think spoke to a friend (who is a police officer) who (I can't for legal reasons) told me that I had no record.

So for a basic offence this won't show up on a CRB check although I do not know if it will show up on an enhanced CRB check - I doubt it will though.

Diz,
P.S I was arrested <17 for criminal damage (no costs, criminal record wiped at the age of 18)

You have now confused me.

You clearly stated in your original post that it was Section 14A (which is indeed a criminal offence).

Are you now stating that you were banned under 14B (Civil)?

Quite honestly, whichever way you look at it, both A and B = hooliganism.

A.Guest I thank you for replying to my question but you have an iignorant view on the issue. Under section 14B the police can ask the courts for a banning order if for instance I was reprimanded for assault which had no relivence to football.

The evidence they had of me was in a pub with a group of mates thats all they needed to ask for a ban to be imposed.
My ignorance has been confounded by your confusing comments.

I still remain unsure whether you are banned under 14A or 14B. There is certainly ambiguity in your.

However, if you feel that mycomments do not relate to your question I will withdraw and engage myself in more important issues.

Section 14B Football Spectators Act 1989. (civil)
This is what is on my bundle of documents from the case.

regards.
Just to remind you what you originally typed 14A 14A . . . . . .

I've got a football banning order section 14A of the Football Spectators Act 1989

Once again - good luck
Also - you did post your question in Criminal Law category . . . . .

I know, Sorry for the mis-understanding. While I did post this in criminal category this does not mean that it's a criminal case. I just wanted to get the quickest responce. I also tried to post this in civil but it was removed.

Thanks again :)

Just found out that, Section 14B is not a criminal conviction, will not be held on my record after the 3 years has been completed and it will not show on a CRB! Happy Days! :-D
What did you do to recieve the banning order, always interesting to know!

Well this is what they used as evidence, I've been with this girl now for 3 years but at the start of our relationship her ex ex boyfriend sent me an email saying he was going to stab me ect ect. Anyways we saw him and a group of his mates outside a shop verbal abuse from his mates kicked off a little set 2 between us, I right hooked him and that was that, he wasn't willing to fight. So I got a reprimand for that because he went home and got his mammy to ring the police. Anyways at a Newcastle match (i'm a boro fan) I was with a large group of "risk" supporters anyways we were penned up against the old city walls while 200 Newcastle fans threw half bricks and bottles at us. I was seen arms spread after a brick hit me straight in the face. This was there evidence that I was a football hooligan.

And thats that.
