my ex husband and his girlfriend go out drinking and leave our 13 year old daughter in charge of 4 kids under the age of 8. is this legal

Depends what county you are in. Although it's morally wrong regardless.

In my town there is no law on what age you leave your children but if something happens to them while they are unattended you could get prosecuted for neglect.

Who does she live with? How often does this happen?

14 seems to be the suggested age but even at that 4 kids under 8 is a lot to deal with

I wouldn't look after 4 kids under 8 unless it was an emergency....
