Can overhanging branches, twigs etc be broken snapped or torn off and thrown into the "Tree owners" garden or do they have to be cut or pruned & handed back. With the tree ownes agreement can they be disposed of without retuning them to the owner?

You are within your rights to trim and prune the overhanging branches etc. However, I would recommend that you tell neighbour what you are doing and I would not throw them back into neighbour's garden. Your neighbour should dispose of trimmings as they are his/her property.
if you are doing it then you should do it in a tidy way that won't hurt the plant, so carefully pruned, not broken or torn off, You should mention it to the owner first and although strictly you should hand the prunings back, they may agree to your disposing of them. We have a man in to cut back the tress at the bottom of our garden about yearly. We have never returned the cuttings and both sided have benefitted as the growth has thickened up and improved privacy on both sides.
