cancelled direct debit for gym and now in trouble!

i cancelled the direct debit for my gym membership that ive had for almost 3 years as i can no longer afford it. ive now had a letter saying i should have given 2months notice and pay a late payment fee of �35 and 2months membership as well. i just dont have the money for this i have a IVA already and dont have that kind of cash to spare HELP!!

had you signed a new contract with them? I think that unless youve signed a new one it just continues on a month by month basis usually.

didnt the advice you receive when you started your IVA cover things like cancelling contracts?
I think that gym memberships are automaticly put on yearly contracts unless you cancel. Thia would have been in the terms and conditions you had when you started as well as the cancelation policy.

If you can add it to your iva or contact them and make arrangements to pay it off at x amount per month untill paid.
tell them you cant afford to pay it simple as and for them to take you to court. you will find they will not waste their time with such a small amount
Write and tell them you've been made redundant and can't afford the membership till you are re-employed.

Mention you will re-join the club when your finances are more stable. Hopefully, they'll understand and let you off?
Not in my experience - this industry are pretty hard-nosed about enforcing contractual terms. Worth trying though.
The gym my sister went to allowed you to stop paying full membership and put her on some sort of stand by thing. She had to pay �5 a month but wasn't allowed to use the gym untill she started up her full membership again.

It saved her having to pay �40 a month.
I also had a gym membership and stopped the DD after 12 mths. After about 2 months I received a letter asking me to make the missed payments. I wrote back stating that my contract was only for 12 months, and I would not be renewing my membership. Never heard anything since. They may be trying it on , check your contract.
Bet I know which gym this is as I and a couple of friends had the same problem and ended up having to pay the 2 months (located in very tiny small print). Bearing in mind the IVA why don't you just try offering to pay what you can afford and see what happens.. good luck
