We have just come back from a day out at a place run by Leeds City Council. The car park spilled over onto the huge grassed area which was horrendously unlevel and really muddy in places. The charges were �3.50 for a car (all day). Because of the state of the car park and how busy it was and how many cars we saw didn't have tickets on them to say they had paid we decided not to bother as well! We got away with it but when looking at the notice next to the pay machine there was nothing that stated what would happen if you got caught without paying like us. Don't they normally have to say how much you will be fined or something and if we had have got a ticket would it be enforceable?

Thanks for your detailed answer!! If I had been caught without a parking ticket then what would have been the penalty? Surely they have to have it displayed so you at least know what is going to happen?

Invisible - don't pay it. That is NOT a fine, it is an invoice.

If you refuse to pay and they wish to enforce it, they will have to sue the driver in the civil court. They have no idea who was driving.

They will have to prove the driver was in breach of contract. The driver can only be in breach if he or she were aware they were forming a contract.

If you cannot remember who was driving, and they can't provide photographic evidence, they have fell at the first hurdle.

There are template letters on the internet for this sort of case.

Mostly it is too expensive and too time consuming for these people to pursue it in court and there are too many defences for the motorist for them to bother.
does anybody think like me if you pay for a car park they are responsible for the safety of you and your car while you are on thier propity?
