Scratch damage to my car by child on bike

Recently my car was damaged by a five year old riding a bicycle on the pavement. The boy crashed into my car which was stationery half on half off the pavement when the accident happened leaving a long scratch. Have tried to take up the matter with the parents I don't seem to be getting any where. Can I claim through my insurance against a five year old boy or maybe his parents?

This happened to me some years ago where a child drove into the side of my car with a scooter. I had asked the child to stay away from the car and spoken to the parents.

When the damaged occurred I popped to my local Police station and asked their advice, they went to see the parents and the parents paid for the scratch to be taken out of the body work.

I am not sure if this has now gone past the point where the Police would get involved but its worth giving them a call (obviously not 999)!
It is illegal to park even half on the pavement so the parent may argue that had you been parked legally it wouldn't have happened. That is if they admit their child did it, of course.

You can't bring action against a five year old - he is below the age of responsibility.

The parent wouldn't be insured for this sort of thing, and your insurance company wouldn't want to get involved in taking the parent to court to claim damages.


You claim from your own insurance or pay out of your own pocket - it was an accident.

The police won't turn out when two cars hit each other, unless there is a personal injury. They certainly won't be interested in your scratched car.

Most of us car owners have suffered from scratches and dings not caused by the car owner. It is one of life's irritations.

this nearly happened to me and my 4yr old last week. She was riding her bike on the pavement as children tend to do and strugged to fit past a car which was parked as you describe. I certainly wouldn't be forking out money for the car to be repaired if she had of hit it. It shouldn't have been on the path, simple. I'm not saying you deserve for this to have happened but if you had have parked on the road where your supposed to bethen it would have been avoided.
