I have a credit card issued by my bank. Unfortunately I have had to give up work because of illness and can no longer afford the repayments. I have two accounts with the bank, one is a joint account with my husband and the other is just in my name. The direct debit for the credit card was from our joint account. I have cancelled this direct debit, and when I checked my own account they have taken this months payment out of this account. Can they do this as I have not given them authorisation to do so? The money that is in my account is from a will of which I am executor and have to pay out to other people.

They shouldn't be able to do this - but there is probably somewhere in the small print that allows them to.

 

They would not have a direct debit in place to take this out so you should be covered under the direct debit guarantee scheme.

 

Even though the bank is the same, they will usually have different departments. I had a similar problem with my mortgage payments (i bank and have my mortgage with the same bank).

 

Get hold of the customer services department and complain.

If the company have set up a direct debit on the second account then they must have got that account number from somewhere - possibly you. If you definitely haven't authorised it then insist that your bank do an "indemnity" and put the money back into your account. One reason for an indemnity being valid is that you haven't authorised the DD.
