Care home woes...an update

For those that have been following my (should i say my wife's) endless hastles and have given us endless help and advice since she resigned from her care home job, i'd like to tank you all and give an update on this bully of an ex employer.

last week, we took out county court proceedings against her for unlawfully witholding wages, statutory sick pay and entitled annual leave...a total amounting to �922 including the �65 court fee.

I have also been to the CAB regarding constructive dismissal. They have given me a draft letter to take out a modified grievance proceedure against her for....

constant verbal abuse,
Giving a reference with several false allegations in.
failing to provide a copy of my wife's personal file under the freedom of information act,
failing to forward my wife's P45
Preventing my wife from doing her NVQ3 after allowing her to do so initially
Unlawfully witholding wages
unlawfully witholding holiday pay
unlawfully witholding statutory sick pay

If there's anything else....i'll let you know.

So, i'll type up the grievance tonight and then she has 28 days to respond. THEN, i will take her to a tribunal

I WILL NOT LET THIS BLOODY WOMAN GET AWAY WITH WHAT SHE'S PUT MY WIFE THROUGH.

Good for you Andy!!! Don't let this woman get away with all the trouble she has caused.Some people think that being in a position of authority gives them the right to treat others appalingly.I hope your wife gets all the money she is owed and you can put it all behind you both.x

Quick update. The woman sent us a cheque yesterday...for �111. That included a �90 deduction for "training refund" and a �40 deduction for "uniform"....both deductions being unlawful because it doesn't say in my wife's contract that she has to refund training costs or uniform (which we returned 2 weeks ago) costs.

Well done for going with it - and please send my regards on to your wife who is being exceptionally brave. It is always difficult to be the first to stand up to a bully.

Thanks...the cheque has been photocopied and sent back by recorded delivery.

Thanks for the kind words for my good lady too. She has since started a new job as a care coordinator....much better than before, better pay and conditions and the people in the office are nice to her !!!!
