Hi i received a court summons for "used a motor vechicle on a road or public place without insurance" Which i had hoped nothing would come of but now it has... 4 months ago i brought a second car as my mg midget is starting to pop and bang! 2 days after owning the car me and my friends had wanted to go to town, my mg midget takes 2 people theres 3 of us... however one of my mates is insured to drive any vechicle 3rd party... With this in mind i said use my car so we did.. After being in town for a few hours my friend in fact all of us got drunk... so they went on to a mates house and i was left in town.. As i was uninsured and drunk i jumped into my car and fell asleep planning to get my friend back to drive me and the car home in the morning.. Well i got woken up by the police, i told them i had no intentions of driving the car, obviously i was asleep and drunk.... The car was registered as having no insurance so they inpounded the car and sent me on my way.. Now i have to go to court and explain why i had no insurance.. What do i do? Plead guilty to using a car on a road, or plead not guilty, as i didnt use the car and my friend was insured to use the car to get there? i have 6 points for speeding so im looking at a ban? even tho i thought i'd been 100% legal Any ideas what the courts will say and possible out comes.. Thanks

Just read all the other "its not my fault but I got caught with no insurance" type questions. You were not insured - It is an absolute offence - You will get done - 6 points so you are banned.
Whenever I post a question - I get a list of similar questions that have been asked - it seems that nobody reads these.
Now cue the answers from Norman the dog and Panic button (and a sensible one from Ethel of course) Take it away........
yep,another idiot who thinks its ok to have no insurance,well its a good job he will get banned now.

More to the point, you were in a car, drunk by your own admission, if you had the keys in your possession you were VERY lucky not to get done for drink drive offences!!
The car was on the highway without insurance. For an insured friend to drive your vehicle in the way you describe, the vehicle must not be parked in any public place or highway. As soon as your friend left the vehicle, the vehicle was uninsured.

You seem to make a habit of sleeping in your car whilst drunk.

Plead guilty and expect a ban.

I know the four months match for it to be the same event, but few of the other details tally.

A subsidiary question. Surely it can't be an offence to have an uninsured car parked on the road because as I understand it, insurance covers drivers, not cars? Therefore it can only be an offence if the car is being driven by someone who is not insured to drive that vehicle. I only offer this up for debate, so I will be quite happy if someone more knowledgeable puts me right!
A vehicle MUST have minimum 3rd party insurance to be parked on the public highway - the law says so:
