Ok, i admit, im a smoker and addicted, but does anyone understand the new law with regards to smoking at work, for example, i work in an office, and i know we cant smoke on site, but if my car ]is on site, in an underground car park of the office, can i legally smoke in my car whilst it is parked in the underground car park of the office (its myown persoanl car not a company car)? thanks richard
If your employer says not then no. Even though it is your own car your employer has provided parking under their conditions. It's pretty much a civil situation in the case you are talking about.
its not a criminal offence to smoke in your own car off company property Zacmaster!
The law only applies to company pool vehicles. If the company cars are not pooled then it does not apply, but...employers can still enforce this on the company vehicles, like or company.
You can't smoke in any public enclosed space - so not in the underground car park itself, but you can smoke in your car.
If your car is itself in a public enclosed space, then I guess the answer's no, although maybe it's allowed if you keep the windows and doors closed and only open them when you're back out in the open.
