my employers vans tax disc which i drive has run out, will i get fined or penalty points for driving it whilst untaxed or both of us ?

It's the drivers responsibility, you will get prosecuted not your employer, you therefore have reasonable grounds to refuse to drive it.

no, the company is responsible for th vehicle being road legal. Is he vehicle leased or owned? The answer will make a huge difference on liability
Your employer has committed an offence for failing to ensure the vehicle is 'road legal'.

If you drive the vehicle, you will be committing an offence for using it untaxed.

thanks everyone for your answers, i went to work today and refused to drive the vehicle, and hey presto she paid online there and then... pheww.
