Who's Liable for the Insurance Penalty?

Pleeeeeeeease if anyone can help asap:



If X owns a car and gives Y's name as the owner of the insurance (instead of just being a named driver), but the payments go out of X's bank account, then when X decides to cancel the insurance, who is liable for the �50 penalty fee the insurance company are charging?

who ever is paying the premiums, if both then split it.
the insurance company will persue the outstanding money from the policyholder only (in this case person y) as this is who the contract is with. it would be the same if there was a refund due- the policy holder & not the payer would receive it
