In Scotland, can a private individual use recordings if hi/her phonecalls as evidence in court ?

I dont think so becuase you've set them up. If you have ever rang a company like tesco for instance they will have a recording of "This call maybe recorder for training and security puposes" Well somehting like that, so it has informed you of the fact that you maybe being recorded so you are forewarned like a disclaimer ..It is a difficult one.

In England it is legal to covertly record conversations, it`s covered under Sect 70 P.A.C.E. It states that someone must know and someone must consent, that person is you. Alot of the local scumbags have warnings on their PNC/CIS that they record.
