our house in in my wifes name only, i pay her an amount each month equal to 100% of the mortgage which she pays out of her bank account


i pay another amount equal to half the endowment premiums


if we were to split, where would i stand?

If you were to divorce and couldn't agree on a split of assets yourselves, the Courts would look at splitting them in an equitable manner (taking into account all relevant factors, including children) - the total value of the house would be brought into the equation, and the fact it is in one name only would not affect the outcome.However, if you were to start divorce proceedings, it would be advisable to have your interest in the property noted on the deeds - this will prevent it being sold without your permission. Your solicitor would do this for you as soon as you instruct him/her to act for you.
