I split with my partner (not married) of 21 years at xmas as he walked out on us after our kids found he had been seeing 2 other women since last august.Anyway I am trying to broach the subject of car ownership.

10 years ago my nan died and left me a fair amount of money and i purchased a mitsubishi evo for £20,000 cash from a private seller.This car was like a weekend car a bit of fun,and was registered in his name as I hadnt passed my test at the time.Over the years have spent probably the same again on it modifications etc for track use.Now when we split,luckily the car was with a mechanic waiting for repairs,his parents demanded I hand over all the paperwork to them as its their sons car,I tell them that the v5 states the person named is the registered keeper and not necessarily the legal owner.

I have also clarified this with the police who said ultimately it is whoever paid for the vehicle,IE me,I have bank statements that show the £20k being withdrawn,but being so long ago the bankcard I had then obviously expired and the bank said there is no way they can check if it was my card or his that was used,but I can prove that had it not been for my nans inheritance we would not have been able to purchase the car in the first place.
The private seller wrote a receipt with my name on,which I still have somewhere,and am still in contact with them so could ask their help if need be.
Basic line is,is there anyway I can get the v5 transferred to my name without getting him to sign,for ex asking dvla,I highly doubt it,but I know he will not sign it if he knows I am going to keep it,he cant afford to run it and expects me to sell it and give him half of what it sells for.
Once the repairs are done I will need to get it back home and have cancelled the original insurance policy after being told by the insurers that it would no longer be valid anyway as my partner is no longer living at this address and would have to reinsure myself.This could be an issue as it asks if the proposer is the registered keeper of the vehicle and as I am the legal owner but not the keeper,I can see that causing a problem.
We both own separate cars ,so you may say why do I still need this,but having spent so many ££££ on it over the year and the fact I am attached to it and it goes back to my nan I am adamant i dont wish to sell it.

Cops told me possession is 9/10th of the law so its good that it was not in his possession when we split ,but I just dont know how to approach the subject with him because he is not going to take this lying down

I'm not sure why you're so keen to have the v5 in your name as by your own admission "the v5 states the person named is the registered keeper and not necessarily the legal owner."
Ask your ex for proof of Purchase / Repairs, running costs, as far as I can see,he has no claim to the car, if problem start contact the police. good luck. x
I'd fill in a Form V62 with your details filled in, and the fact as the previous owner didnt send off your details for you to receive a v5 in your name.
And i would find that receipt, if you cant explain the situation to the previous owner and ask for a replacement, and i'd also ask him to write a statement etc saying its a replacement, i've no idea of the current value etc, but if this goes to court at some point later you need to be 'clean' so to speak. So far as registered keeper as you are the legal owner, and are now the keeper i'd still apply for a v5 via the v62 route.

I'd also post in the law section of these boards, and/or contact your CAB, or a solicitor. I have no idea what the law is ref what he's entiltied to etc so i'd find that out/get it worted before you speand too much £ on it.
